GiftVault.com (“GiftVault”, “the Site”) and other related services are made available to you in accordance to the following Terms & Conditions and any other rules posted on GiftVault ("T&C"). Please read the T&C carefully before using GiftVault.

Please note, you will have to be over 18 years old to transact through the Site. By placing an order you certify that you are aged 18 or over. 

We may amend the T&C from time to time. You should review the T&C periodically for changes. If you do not agree to these Terms & Conditions then please refrain from using the Site.

REGISTRATION / SIGN UP

In order to use many of the functionalities, services or features available on GiftVault, you will need to register or sign up. When you register or sign up, you are requested to provide information about yourself that is true, accurate and up-to-date. Should any of your registration information change, please notify us immediately at support@giftvault.com or make the amendments on your account.

ELIGIBILITY TO PURCHASE 

In order to make transactions on the Site, you will be requested to register and/or provide your personal details. Customers must provide real and true personal information where requested. When ordering items in the checkout process it will be mandatory to complete payment details, and you represent and warrant that the details you provide are both valid and correct, and that you are the person referred to in the billing information provided.

By purchasing products, you authorise us to perform credit checks and, where GiftVault feels necessary, to transmit or to obtain information about you to or from third parties from time to time.

By making a transaction on GiftVault, you agree that we may use personal information offered by you in order to carry out any appropriate anti-fraud checks. Personal information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

ORDERS

All orders are subject to acceptance and availability. If the goods ordered are not available, you will be notified by e-mail (or by other means if no e-mail address has been provided) and you will have the option either to wait until the item is available from stock or to cancel your order.

Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. You acknowledge that any automated acknowledgment of your order which you may receive from us shall not amount to our acceptance of your offer to purchase goods or services advertised on the Site. The conclusion of a contract between you and us will take place when we (i) debit your credit or debit card or (ii) dispatch the goods to you or commence the services, whichever is the later.

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be liable for any loss you may suffer if a third party procures unauthorised access to any data provided by you when accessing or ordering from GiftVault. 

PRICING

Prices shown on the Site are in GBP, EUR or USD and are inclusive of VAT. All final payments will be taken GBP. 

All prices and offers remain valid as advertised from time to time. The price of a product displayed on the Site at the time the order is accepted will be honoured, except in cases of technical errors.

Customers purchasing from a country served as DDU (Delivery Duty Unpaid) will be charged for the items purchased and shipping costs only. Import duty or tax costs will be invoiced to you directly from DHL or an import broker appointed by you. We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion.

PAYMENT

Payment can be made by American Express, Visa, Visa Electron, JCB, MasterCard, Delta and Maestro. Occasionally we may accept other methods of payment which will be clearly advertised on the site. You as the user/buyer verify that the credit/debit card that is being used is yours or that you have been officially authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment, we shall not be liable for any delay or non-delivery. 

We use a secure and relaible payment gateway, Sagepay. For more information please visit www.sagepay.com.

We will do everything in our power to keep the details of an order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.

INSURANCE AND DELIVERY

Each purchase is insured by GiftVault during the time it is in transit and until it is delivered to the specific delivery address. All goods sent out will require a signature when delivered, at which point responsibility of the purchased good becomes yours or the detailed recipient. This means that you accept that evidence of a signature by them (the recipient or that delivery address) is evidence of successful and fulfilled delivery by GiftVault. Please note, GiftVault are not responsible for any delays caused by customs clearance processes or other extenuating circumstances. 

TRACKING YOUR ORDER

You will be able to check and track your order by signing into your account and directly clicking the link ‘order status’. GiftVault will send a confirmation email that will include login details to your account and an email will also be sent with the tracking number and courier service details. 

RETURNS AND EXCHANGES

You have the right to a full refund provided you give written notice within 7 working days of receipt of goods. Notice must be given in writing to: Contract Cancellation, Customer Care Department, GiftVault, 64 New Bond Street, W1S 1RW, Mayfair, London  or by email to support@giftvault.com. We will contact you subsequently to discuss returns. 

We cannot refund shipping costs. It is your responsibility to return goods to us and to ensure that all products are returned unused and in the original condition and packaging as they were dispatched to you. We will not be responsible for loss or damage in transit back to us and as a precaution we advise that you retain proof of sending.

Refunds will be issued within 14 days of us receiving your cancellation notice.

Products should be returned with all tags still attached and complete with any certificates of authenticity, presentation bags and boxes etc. Returns that are damaged or soiled may not be accepted and may be sent back to the customer and/or a refund refused.

Please note that items that are damaged as a result of normal wear and tear are not considered to be faulty.

PRODUCT COLOURS

GiftVault has made every effort to portray the variations of colours as accurately as possible; however due to variation specifications on monitors this may vary slightly.  

INTELLECTUAL PROPERTY RIGHTS – COPYRIGHT, TRADEMARKS & INTELLECTUAL PROPERTY

As a user of GiftVault, you have no rights in relation to any copyright, designs, trademarks and any other intellectual property and material rights relating to the content including GiftVault code and all HTML and other code contained in the Site. All such content, including third party trademarks, designs and related intellectual property rights mentioned or displayed on the Site are protected. Any imitation or redistribution of the designs, trademarks, copyrights etc on the Site is illegal and prohibited. The necessary precautions will be taken.

THE USER

You will be personally responsible for your use and activity on GiftVault. This includes all types of communication, uploads and activity on the website. If there is a violation or a report of abuse and we decide that you are or have been engaged in prohibited activities, or were not respectful of other users, we could refuse you access to the Site, temporarily or permanently. Please see below a forum use guideline.

THIRD PARTY SITES 

We may include hyperlinks on GiftVault to websites or resources operated by third parties, including advertisers. We have not reviewed all of the sites linked to GiftVault and are not responsible for the content or accuracy of off-site pages nor are we responsible for the availability of such external websites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offense caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such websites or resources.

LIMITS ON OUR LIABILITY 

We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If GiftVault breaches the T&C we shall be liable only for losses which are direct losses and a reasonably foreseeable consequence of such a breach. Losses are foreseeable where, for example, they could be contemplated by you and GiftVault at the time of you placing your order, and GiftVault dispatching your order. We shall only be liable for losses up to 150% of the total value of goods purchased. 

We are not responsible for losses not caused by our breach or negligence, indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us (for example, loss of profits or loss of opportunity).

We are also not responsible for failure to meet any of our obligations under the T&C where such failure is due to events which are beyond our reasonable control. 

Bespoke Returns: GiftVault ltd cannot offer a refund on a bespoke order. Products that have been purchased that are specifically made for a client cannot be returned.

GiftVault Mothers day Competition Official Rules

 

1. ELIGIBILITY:  You must be eighteen (18) years of old or older to participate in the GiftVault.com Mothers Day Competition 

 

2. ENTRY:

To enter the GiftVault competition, visit http://www.facebook.com/GiftVault and “Like” the GiftVault.com fan page and become a fan. Once a fan, upload your photo to the third party application, found on the contest tab. Once submitted, you are officially entered into the GiftVault competition. GiftVault is not responsible for failed uploads.

 

(b) Content Restrictions: Each photo submitted must be submitted by a single individual. Group entries will not be accepted. The Submission must be an original photo taken by the individual and the subject cannot be public or in a public place. Public photos or any photos found on the Internet will not be accepted. The entrant must be the sole owner of the copyright of the photo submitted and the submission of the photo is a guarantee of this. The Submission must not contain material that violates another's privacy or intellectual property rights. The Submission must not contain material that is inappropriate. If any photo is deemed to be copyrighted, offensive, artificially enhanced a studio image, or of poor image quality, it will be disqualified. Submissions generated by script, macro or other automated means are void. Uploading a Submission constitutes Entrant's agreement that they shall have no claim to compensation or benefits (other than as specifically set forth herein) nor any claim, including, without limitation, claims based upon invasion of privacy, defamation or right of publicity, arising out of any alteration, blurring, distortion or use in composite form of Entrant's Submission (including Entrant's name, picture, image, likeness, voice or biographical information). Released Parties are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Submissions; all of which will be void. In the event of a dispute as to any Submission, the authorized account holder of the email address used to register will be deemed to be the Entrant and must comply with these Official Rules. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each Entrant may be required to show proof of being an authorized account holder.

 

(c) Right to Disqualify: GiftVault reserves the right to disqualify and remove at any time any photograph/Submission that it believes in its sole discretion infringes any third party’s copyright(s), rights of privacy or publicity or other intellectual property rights, contains any sexually explicit or inappropriate content, is not suitable for publication, is a studio image, contains animation or artwork, clarity and/or resolution that it is not appropriate for use in an advertising campaign or has been modified. Sponsor further reserves the right, in its sole and unfettered discretion to verify at any time during the Contest that all necessary Clearances relating to any photograph have been obtained and to disqualify and remove any photograph if it believes in its sole and unfettered discretion that the necessary Clearances have not been obtained.

 

3. PRIZE/VALUE/ODDS: There will be one (1) winner of one (1) prize consisting of one (1) A stunning bouquet of Jane Packer flowers and 24k Oro Gold serum Actual Retail Value (“ARV”) £350

No substitution of prizes is permitted except by GiftVault.

Odds of winning the Prize depend upon the total number of eligible Entries, votes received by the Facebook fan community as well as Sponsor’s selection from the top ten (3) submissions as voted by the Facebook fan community based on aesthetic appeal.

 

4. VOTING:  Any user can vote on a photo without having to ‘like’ GiftVault.com’s Facebook Page. A user can submit one (1) vote for multiple photos per day. However, a user may not submit multiple votes for one (1) photo per day. Voting occurs between 9:00hrs Greenwich Mean Time (GMT) December 13th, 2011 through 23:59hrs GMT 23rd December, 2011.

 

5. WINNER SELECTION: The winner will be selected and announced on the GiftVault fan page wall by GiftVault on March 15th, 2012 from the top five (5) submissions as voted by the Facebook fan community, based on aesthetic appeal.

6. PRIZE CONDITIONS: If a winner is a minor in their primary residence, the prize will be awarded to the parent/legal guardian. If the selected winner cannot be reached to organize delivery of the prize they are not in compliance with the official rules and will be eliminated from the competition and an alternate winner will be selected from among the previous top five (5) submissions. The prize is not redeemable for cash or transferable. No substitution is permitted except by GiftVault. Any expenses on the prize such as those related to loss or damage are the responsibility of the winner. Entry and acceptance of the prize permits GiftVault to use the winner’s name without additional compensation, notification or permission. The winner is responsible for all country, state or local taxes, if applicable.

 

7. OWNERSHIP and LICENSE: Entry in the competition represents the entrant’s consent, to use, reproduce and modify the entry including editorial, commercial, and publicity purposes. GiftVault shall have the right to edit, adapt and modify the Entry.

 

8. GENERAL:  Participating entrants agree to these Official Rules and the decision GiftVault.
